Em 20 de dezembro, o Tribunal Penal Internacional (TPI) em Haia anunciou que a promotora Fatou Bensouda estava “satisfeita por haver uma base razoável para iniciar uma investigação sobre a situação na Palestina”. “Há uma base razoável para acreditar que crimes de guerra foram cometidos ou estão sendo cometidos na Cisjordânia, incluindo Jerusalém Oriental e a Faixa de Gaza. ”
Claro, isso deveria ser óbvio – e mesmo assim levou quase cinco anos (um “exame preliminar” da situação foi aberto em janeiro de 2015) para que o TPI chegasse à conclusão de que “não há razões substanciais para acreditar que uma investigação não serviria aos interesses da justiça”. E, no entanto, os palestinos estão esperando há mais de setenta anos por justiça, então, comparado a isso, talvez cinco seja até pouco.
Não que a “justiça” seja um resultado garantido nos empreendimentos jurídicos internacionais que muitas vezes equivalem a charadas torturantemente burocráticas. Tampouco, é importante ressaltar, a investigação da Palestina recebeu sinal verde oficialmente – Bensouda está primeiro buscando confirmação de que a jurisdição do tribunal se aplica ao território em questão. O artigo segue nessa toada – e o único ponto fundamental é que Ehud Olmert não deveria escrever artigos de opinião se ele não souber qual é a sua opinião.
Outro artigo de opinião no Jerusalem Post publicado no mesmo dia – “Recusando jogar o jogo palestino do TPI” – é bem mais seguro em suas convicções. Nele, Nitsana Darshan-Leitner discute como “o TPI e a ameaça de investigações de crimes de guerra são apenas a versão mais recente da OLP da diplomacia de galho-e-pistola [de oliveira] de Arafat [último líder da OLP]. Só estaria acontecendo porque “Bensouda estava cansada de perseguir ditadores africanos e líderes tribais brutais, e queria mostrar que o TPI é um tribunal com alcance verdadeiramente internacional”. Portanto, não haveria “nada mais sexy” para ela do que o conflito Israel-Palestina.
